Enactment, Revision, and abolition of ordinances

Function of Council

The local council keeps the rights of resolution about the enactment/revision, or /abolition of ordinances, reviews/confirms budget plans and approves settlements, provides consent/approval of important matters, duly participates in the enforcement of policies keeping the right to control for administration enforcement of administrative by means of audit and investigation. Besides, the council may process the affairs relating to the given rights by means of other statutes and ordinances as well as reception of petition.

Enactment, Revision and Abolition of Ordinances

Ordinances are the form of law enacted by autonomous local governments through resolutions of the local council and in line with this, the Ordinances of Ulsan Metropolitan City considered to be law. Ordinances can be enacted regarding the affairs of the city within the scope of the law, and ordinances with details that impart disadvantages in excess of what the law stipulates cannot be enacted. Rather, the currently implemented law stipulates that ‘there must be a delegation of law when deciding on the issues or penalties regarding the limitation of rights or imposition of the obligation of citizens. Au autonomous local government may enact ordinances that stipulate penalties of less than 10 Million Korean Won for actions infringing of upon the ordinances.

Procedures in Enactment of Ordinances

    Initiative
    More than 1/5 of registered councilors or more than 10 councilors, Mayor, and Educational Superintendent
  • 02

    Examination by the Standing Committee
    Explanation, questioning, and discussions on the proposal
  • 03

    Resolution at the Plenary Session
    With the presence of a majority of registered councilors and by the vote of the majority of councilors present
  • 04

    Transfer
    To be transferred to the Mayor and Educational Superintendent within 5 days of the resolution
  • 05

    Proclamation
    To be proclaimed by the Mayor and Educational Superintendent within 20 days. Unless otherwise stipulated, the ordinance will be effective 20 days after the proclamation.
